The illegal stay put of Ibrahim Mustafa Magu at the Economic and Financial Crimes Commission, EFCC, as the acting chairman has been challenged at the court, DENISAURUS News can exclusively reveal.
Mr Magu, 58, a “perennial offender,” was indicted by the Department of State Services, DSS, which resulted to his rejection by the National Assembly in December 2016 and again, March 2017. This makes him the first and only nomination to be rejected in the history of the anti-graft agency.
According to the EFFC ACT 2004, an individual seeking to be the chairman of the EFCC, must be confirmed by the senate, but Mr Magu was rejected by lawmakers who screened him for the role he has been acting in, for more than five years.
Contrary to the Public Service Rules, Mr Magu can only be in an acting position for 6 months.
Mr Magu, who has been rejected twice based on the DSS report, which described him as a liability to President Muhammadu Buhari’s anti corruption fight, has now been challenged at the court over his illegal stay.

Sources at the EFCC told DENISAURUS News that Mr Magu, absconded the Headquarters’ Abuja office quickly on Tuesday (19 May 2020) in order not to receive the court summon.
Mr Magu, whose promotion was exclusively reported by DENISAURUS News, also ordered his personal staff not to collect the court suit no FHC/ Abj/ CS / 356/ 20, which was filed by a legal practitioner Agu Obasi Esq.

DENISAURUS News, which has seen a copy of the court summons and hearing notices of a suit challenging his continued stay as EFCC chairman, understands the case will be transferred from the General Cause List to the Hearing Notice Thursday, 21st May 2020.
President Buhari has also been served a copy of the suit. A copy of the suit sent to the President has also been obtained exclusively by DENISAURUS News

The suit is seeking a declaration that Magu being a public servant, cannot continue to stay in office in an acting capacity beyond the statutory 6 months prescribed by the Public Service Rules.
This paper understands that when the Court bailiff from the Federal High Court Abuja went to serve the court processes, the EFCC acting chairman made himself unavailable to collect the document.
Insiders also noted that senior officials of the Commission, loyal and acting on the instructions of the Mr Magu, refused to accept the process in an effort to resist service.
Copies of the documents were also sent to the Attorney General of Federation, Abubakar Malami, a Senior Advocate of Nigeria.
Mr Magu, whom DENISAURUS News had published exclusive news about his desperate move to become confirmed – including visiting several spiritualist, has recently been exposed for using a prophet to launder money.
Prophet Emmanuel Omale, who constantly prophesied about Mr Magu’s confirmation (although it never came to pass), purchases properties for the anti-graft boss, in places like Dubai.

The duo, who travelled to Dubai in March 2020, have constantly sent people to the paper promising to compensate staff reporters if the “factual” story is removed from the DENISAURUS News  website.
Meanwhile, several efforts made to get a reaction from the recently appointed spokesman for the EFCC, Mr Dele Oyewale, on the reason for the anti-graft agency refusing to accept the service suit on behalf of Mr Magu, could not yeild any fruitful success.
