Dino Melaye, the Senator for Kogi West, has launched an appeal at the Appellate Court against current plans to remove him from office.
On Monday, a Abuja Division of the Federal High Court gave Independent National Electoral Commission, INEC permission to process the lawmaker’s recall, despite a petition being signed by only three signatories, instead of the constitutionally required number of more than half of the members of the constituency.
Mike Ozekhome, SAN, a representative for Senator Melaye, maintains that the lower court erred in law and is praying the Court of Appeal to set aside the ruling of Justice Nnamdi Dimgba.
Several people from Kogi West, including a man from Ayetoro have sworn an affidavit, to say they were invited by his ward chairman to mobilize signatures of party members.
Other question have arisen over the validity of the petition, because some names of those who have passed away also appeared on the list.
The lawmaker who is said to have vexed the state Governor Yahaya Bello, by calling him out over his failure to pay the salaries of civil servants in the state has vowed to fight on.
